Proving Coercive Control in California: The SB 1141 Story
California Senate Bill 1141 was signed on September 29, 2020 and became effective January 1, 2021. It amended Family Code Section 6320 to explicitly bring coercive control into the state's definition of domestic violence — a meaningful shift for cases where there's no single dramatic incident, just a sustained pattern.
What the bill actually did
SB 1141 expanded the definition of “disturbing the peace of the other party” under Family Code 6320 to include conduct that destroys the mental or emotional calm of the other party — explicitly naming coercive control: unreasonably interfering with a person's free will and personal liberty. The bill gives concrete examples, including isolating someone from their friends, relatives, or other support systems; depriving them of basic necessities; and controlling, regulating, or monitoring their movements, communications, or daily behavior.
The custody consequence
A significant practical effect: the law creates a rebuttable presumption that awarding child custody to a parent who has engaged in coercive control is detrimental to the child's best interest. That presumption can be overcome, but it shifts real weight onto a documented pattern of coercive control, not just a single incident.
