How Long Does WhatsApp Keep Messages — and Can Deleted WhatsApp Messages Be Recovered for Court?
Reviewed by Jacob Reed, founder of Verity ·
Short answer
WhatsApp doesn't keep your messages: once they are delivered, they are deleted from its servers, and WhatsApp says it can't recover deleted messages. Copies live on the phones in the chat and in their backups. Delete for everyone works for two days and leaves “This message was deleted.” Export the chat now.
Unlike Instagram or Snapchat, WhatsApp doesn't store delivered messages at all, so there is no download from the company with your chat in it. The phones in the chat, and their backups, are the whole record. Here is what each kind of deletion does to it.
How long does WhatsApp keep messages?
Ordinary messages
Once a message is delivered, WhatsApp deletes it from its servers. From then on it exists only on the phones in the chat, and in their backups, until someone removes it.
Messages not yet delivered
If the other phone is offline, WhatsApp holds the message, encrypted, for up to 30 days while it tries to deliver it, then deletes it.
Disappearing messages
When this is on, new messages disappear for everyone 24 hours, 7 days or 90 days after they are sent. Messages sent before it was turned on stay. Anyone in the chat can “keep” a message so it doesn’t disappear, unless the sender refuses.
View once photos, videos and voice messages
They disappear after being opened once, or after 14 days if never opened. They can’t be saved, forwarded or screenshotted in WhatsApp.
Disappearing messages don't always vanish completely. WhatsApp says a preview can stay in notifications until the app is opened, a message quoted in a reply can stay visible, a message forwarded to a chat without the timer stays there, and a backup made before a message disappears still contains it until that backup is restored.
What happens when a WhatsApp message is deleted?
Delete for me
Removes your copy only. The other person still sees the message. There are 5 seconds to undo; after that, WhatsApp says it can’t get the message back unless it is in a backup.
Delete for everyone
Allowed for two days after sending. The message is replaced with “This message was deleted.” The other person may already have read it, the deletion can fail without the sender being told, and an iPhone may still have the photo in its Photos app.
Group admin deletes
Admins can delete other members’ messages for two days. The chat shows which admin did it, and WhatsApp says those messages can’t be recovered.
Clear chat or delete chat
Removes the whole conversation from your phone. The other person’s copy isn’t touched.
A message can also be edited for up to 15 minutes after it is sent. Deletions sync to every linked device that is online, so a message deleted on the phone also goes from WhatsApp on a computer.
Can deleted WhatsApp messages be recovered?
Not from WhatsApp. Its help center says that once you delete a message there is no way to get it back unless it was in a backup, and that WhatsApp can't recover deleted messages for you. Where a deleted message can still exist:
- The other person's phone, if the message was deleted only on one side. Deleting a WhatsApp account erases its message history, so if you need their copy, your lawyer should ask them to preserve it early (how discovery works).
- A backup made before the deletion in a Google Account, iCloud or WhatsApp's own cloud storage. There is only one backup per phone number and each new backup replaces the last; Google may delete one that hasn't been updated in five months. An end-to-end encrypted backup can't be opened without its password, key or passkey, and WhatsApp can't reset it.
- Local backups on Android, made every night at 2:00 AM and kept for about seven days in the phone's WhatsApp > Databases folder.
- Screenshots, notification previews, quoted replies and forwards made before the message was removed.
Restoring a backup means uninstalling and reinstalling WhatsApp, and the phone ends up with what the backup holds, so anything newer than the backup can be lost. WhatsApp's own advice, if chats are already missing, is not to delete the backup, make a new one or reset the phone. Export what is on the phone now and talk to your lawyer before restoring anything.
Deleting messages yourself, or turning on disappearing messages once a case is likely, can be treated as destroying evidence; see deleting texts during a custody case and auto-deleting apps and spoliation.
How do you save a WhatsApp chat for court?
1.Export the chat today
Open the chat, then More options (⋮) > More > Export chat on Android, or tap the contact’s name > Export chat on iPhone. Make one copy without media and, if photos matter, one with media. Keep the file in two places, such as your email and a computer.
2.Don’t delete, clear or restore anything
If messages are already missing, don’t create a new backup, reinstall WhatsApp or reset the phone. WhatsApp keeps one backup per phone number and each new one replaces the last, so the backup you have may be the only copy.
3.Turn off disappearing messages in that chat
Open the chat, tap the name, then Disappearing messages > Off. It only protects new messages, so keep any message that matters while its timer is still running.
4.Screenshot what the export won’t show well
Capture “This message was deleted” lines, kept messages and anything quoted in a reply, with the date showing. View once media can’t be screenshotted, so write down what it showed and when.
5.Keep a dated log and ask about the other phone
Note what deleted messages said if you read them first. Then ask your lawyer about asking the other side to preserve and produce their copy of the chat.
An export is a text file, not a backup, and can't be loaded back into WhatsApp, so it stays as it was on the day you made it. Full steps, and what the file looks like, are in exporting WhatsApp messages for court and how to read a WhatsApp chat .txt file. A very long chat may be cut off, so check the first date in the file against when the conversation began.
Can a lawyer get WhatsApp messages from WhatsApp?
No. WhatsApp's privacy policy says it doesn't retain messages once they are delivered, and its records request system is open only to government agencies authorized to gather evidence for official proceedings (it cites 18 U.S.C. §§ 2703 and 2711). The account information report you can request yourself doesn't include messages either. When you report someone, WhatsApp receives up to five of their last messages to you, but that is for WhatsApp's own review, not a record you get back; WhatsApp suggests keeping your own copy of the chat. In a custody or divorce case, the messages come from the phones and backups of the people in the chat.
Can Verity read a WhatsApp export?
Yes. Drop in the .txt file or the zip from WhatsApp, with or without media, and Verity reads it in your browser without uploading it. It shows every message numbered in date order and flags patterns such as threats, gaslighting and message flooding. Verity leaves out lines like “This message was deleted” and “<Media omitted>”, so keep the original export as well. Screenshots work too, with times marked approximate.
Common questions
If I delete a WhatsApp chat, does the other person still have it?
Yes. “Delete for me”, clearing a chat and deleting a chat only remove your copy. The other person keeps theirs unless the sender used “Delete for everyone” within two days of sending.
Does a WhatsApp export include deleted messages?
No. An export is the chat as it is on that phone on the day you make it. A message deleted for everyone shows as a “This message was deleted” (or “You deleted this message”) line, and messages that already disappeared aren’t in it.
Does “Request account info” give me my messages?
No. WhatsApp says the account information report doesn’t include your personal messages. To get the messages, export the chat.
Can a lawyer subpoena WhatsApp for the messages?
WhatsApp doesn’t keep delivered messages, so there is nothing to subpoena. Its records system is only for government agencies. In a civil case, the messages come from the phones in the chat and their backups.
Other apps work differently: see how long Instagram keeps messages, how long Snapchat keeps messages and recovering deleted texts.
