How Long Does Instagram Keep Messages — and Can Deleted DMs Be Recovered for Court?

Reviewed by Jacob Reed, founder of Verity ·

Short answer

Ordinary Instagram DMs don't expire; they stay until someone removes them. Deleting a chat removes it only for you, so the other person still has it. Unsent and deleted messages are left out of your data download, and US law doesn't let private parties get message content from Instagram. So download the conversation now, while it's still in your inbox.

Instagram has three ways to make a message go away, and they do very different things. Which one was used decides whether the message still exists somewhere you can reach.

How long does Instagram keep messages?

Ordinary messages

Text, posts and links sent in a normal chat don’t disappear. They stay in the conversation until someone removes them.

Vanish mode

Messages disappear after they are seen, or when you close the chat. Instagram lets you report a vanish-mode message or chat for up to 14 days after it disappears.

Disappearing photos and videos

A disappearing photo or video can’t be viewed again once it has been seen, unless the sender allowed a replay.

What happens when a message is deleted or unsent?

Delete a chat (or “Delete for you”)

Removes the conversation, or a message, from your own inbox only. It still appears in the other person’s inbox.

Unsend

Removes a message you sent so people in the chat can no longer see it, though they may already have seen it. If the chat or a message around it is reported, unsent messages can be included in the report.

Your data download

The file you can download from Instagram leaves out messages you deleted or unsent. Anything you remove before downloading is gone from your copy.

Can deleted Instagram messages be recovered?

Not by you, in most cases. Instagram says deleting content can take up to 90 days to finish and that copies can stay longer in disaster-recovery backups, but deleted information doesn't appear when you download your data. And Instagram says US federal law doesn't let private parties, such as the other side in a custody case, obtain account content from it; police need a search warrant for message content.

Where a deleted message can still be found:

  • The other person's inbox, if you deleted the chat on your side. In a case, your lawyer can ask the other side to produce their copy (how discovery works).
  • Screenshots you or someone else took before it was removed.
  • A report to Instagram, which can include unsent messages, and can be made for vanish-mode messages for up to 14 days after they disappear.

Deleting messages yourself once a case is likely can be treated as destroying evidence; see deleting texts during a custody case.

How do you save an Instagram conversation for court?

1.Don’t delete or unsend anything

Deleted and unsent messages drop out of your own download, and deleting messages once a case is likely can be held against you. Leave the conversation as it is.

2.Download the conversation from Instagram

In Accounts Center, open Your information and permissions, then Export your information, and create an export of your Instagram profile that includes messages. Instagram emails you when it is ready, and you then have a few days to download it.

3.Screenshot the messages that matter most

Capture them with the username and the date showing. Screenshots show the messages as you saw them; the download has every message with its time.

4.Report vanish-mode messages quickly

If threatening or abusive messages were sent in vanish mode, report the message or chat in Instagram within 14 days of it disappearing.

5.Keep a dated log

Write down what was said in messages you could not save, with the date, and anything that happened around them.

Full download steps, and how to find one conversation in the zip, are in exporting Instagram DMs for court and finding one conversation in the download. Snapchat and WhatsApp work differently: see how long Snapchat keeps messages and how long WhatsApp keeps messages.

Does the end of encrypted Instagram chats change anything?

Instagram stopped supporting end-to-end encrypted chats on May 8, 2026, and told people with encrypted chats to download any messages they wanted to keep. If you had an encrypted chat with this person and didn't download it then, check whether its messages still appear in your inbox and in a new data download.

Can Verity read an Instagram download?

Yes. Drop in the zip from Instagram, in JSON or HTML, and Verity lists the conversations in it so you can pick one. It reads the file in your browser without uploading it, shows every message numbered in date order, and flags patterns such as threats, gaslighting and message flooding. Screenshots work too, with times marked approximate.

Common questions

If I delete an Instagram chat, does the other person still have it?

Yes. Instagram says deleting a conversation only removes it from your inbox; it still appears in the inbox of the other people in the conversation.

Can a lawyer subpoena Instagram for someone’s messages?

Not the messages themselves. Instagram says US federal law doesn’t allow private parties to obtain account content from it. Police need a search warrant for message content. In a civil case, the usual route is asking the other side to produce their own copy.

Are Instagram DMs still end-to-end encrypted?

No. Instagram stopped supporting end-to-end encrypted chats on May 8, 2026, and told people with encrypted chats to download any messages they wanted to keep.
